Registration

1. Only registered users may order Parts on the Website. To register you must.
   1. Provide a verifiable email address and set up a unique password.
   2. Provide a postal code and select a preferred dealer from the Daimler Truck Southern Africa Limited dealer network.

Ordering Process

1. You may place orders for Parts through the Website.
2. By placing an order, you make an offer to purchase the selected Parts subject to these Terms.
3. The Seller reserves the right to accept or decline any order at its sole discretion.

Website Browsing, Stock Availability, and Sales

1. While the Seller endeavors to ensure that the stock availability information on the Website is accurate, stock levels may change and the Seller does not guarantee the availability of any specific Part.
2. Browsing the Website does not constitute an offer for sale. The offer for sale is made when you place an order through the Website.

Payments

1. Payment for the ordered Parts must be made through the secure payment gateway provided on the Website. Debit and credit cards are accepted forms of payment.
2. All prices in this website are in the South African Rands currency (ZAR), Therefore all transactions can only be processed in South African Rands (ZAR). No other currencies will be allowed.

Collection of Spare Parts Orders

1. Parts orders can be collected from authorized agents of the Seller.
2. A One-Time Password (OTP) will be generated upon confirmation of your order. This OTP must be presented at the workshop when collecting the ordered Parts.

Returns and Refunds

1. You may be entitled to a refund or replacement as provided for under the Consumer Protection Act, 2008 (Act No. 68 of 2008) ("CPA").
2. You can return an unwanted Part at no charge, provided:
   1. You return the Part to the authorized agent where the order was processed and collected.
   2. The Part is undamaged and unused, with the original labels and stickers still attached.
   3. They are no missing elements to the Part.
   4. The Part has defects.
   5. You return within 30 days of collection by you.
3. The following will NOT be regarded as defects and will not entitle you to a return:
   1. faults resulting from normal wear and tear.
   2. damage arising from negligence and abuse.
   3. damage arising from incorrect use of the Spare Parts.
   4. damage arising from a failure to adequately care for the Spare Parts.
   5. damage arising from unauthorized alterations to the Spare Parts.
4. Important Information: Please note all reimbursement of funds will be returned to the original Debit Card or Credit Card that was use for the purchase.

Ownership and Copyright

1. All intellectual property rights, including but not limited to copyrights, trademarks, and patents, related to the Website and its content are owned by the Seller or its licensors.

Disclaimer

1. The Seller provides the Website and its content on an "as is" basis and makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or suitability for a particular purpose.

Limitation of Liability

1. To the extent permitted by law, the Seller shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Website or the purchase of Parts.

Governing Law and Jurisdiction

1. These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

Black Friday Campaign

1. Background:

   The promoter of this campaign is Daimler Truck Southern Africa Ltd (“DTSA”), referred to as the “Organiser”.

   1. The “Parts” refer to Mercedes-Benz Truck and FUSO Truck Genuine Parts, as determined by the Organiser.
   2. The “Offering Date” refers to 29 November 2024 only.
   3. The “Offer” refers to the sale of Mercedes-Benz Truck and FUSO Truck Genuine Parts at a discounted rate, subject to the terms and conditions contained herein.
   4. The Offer is limited to stock availability on the Offering Date.
   5. The Offer cannot be used in conjunction with any other offer available from the Organiser or Daimler Truck Financial Services.
   6. The Offer is applicable on the purchase of selected Mercedes-Benz Truck & FUSO Truck Genuine Parts only.
   7. The Part will at all times be used in line with manufacturer’s specifications.
   8. All prices depicted are subject to change without prior notification.
   9. All prices Incl. VAT.
   10. When ordering Parts, you must enter in the correct VIN number or check with your Dealer to ensure the part's design, features and technical specifications are available and fit for the purpose for which you require it.
   11. Where the Dealer or the manufacturer uses symbols or numbers to describe an order or subject of an order, no rights may be derived solely from these.
   12. The manufacturer reserves the right to make changes to the specification, including the design, form, description and colour of the Parts during the delivery period.
   13. The illustrations may show Parts, accessories and items of optional equipment which are not part of the standard specification or Offer.
   14. Parts, Vehicle and product specifications may be affected by availability at the time of production and publication of these terms and conditions and/or accompanying media and are therefore not guaranteed.
   15. Images are for illustration purposes only.
   16. For up-to-date and specific information in relation to the range of models, features, optional extras, and Parts available, including up-to-date pricing, please contact your nearest authorised participating Dealer.
   17. All information contained in this Offer replaces all previously distributed marketing material, including prices and Parts codes.
2. Details of the Offer:
   1. Discounts on products that form part of the Offer shall be at 15% (fifteen percent) when purchased directly from the Dealer, at the Dealer’s premises.
   2. Discounts on the products that form part of the Offer shall be at 25% (twenty-five percent) from the online Parts Portal
   3. Delivery terms will be communicated on purchase.
3. General Terms and Conditions
   1. The Organiser reserve the right to terminate this Offer immediately and without notice in the event that the Offer is found to be or is deemed unlawful. Should the Organiser be required by any legislation, to alter any aspect of this Offer or to terminate the Offer as a result of changes in legislation, the Organiser shall have the right to terminate this Offer with immediate effect and without notice of termination.
   2. Should the events in clause 3.1 occur, all Customers hereby waive any rights which they may have against the Organiser in terms of the Offer and acknowledge that they will have no recourse or claim of any nature whatsoever against the Organiser.
   3. These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.
   4. By participating in this Offer, the Customer agrees to be bound by these terms and conditions.
   5. All information relating to this Offer, which may be published on any promotional material via media is covered by these terms and conditions. In the event of any conflict between the content of such promotional material and these terms and conditions, these terms and conditions shall prevail.
   6. Vehicle specifications may vary for the South African Market.
   7. The Organiser reserve the right to cancel this Offer, or to change the terms at their discretion at any time without notice to the Customer and shall be absolved from any liability whatsoever which may arise subsequent to such cancellation, termination or alteration.
